Terms and Conditions

Unless otherwise agreed with you in writing, my standard terms and conditions are as set out below. These will be included in any quote provided to you.

·  I will undertake this work for the fees indicated and within the timescales indicated in the proposal. The scope and scale of this work will conform to the number of consultancy days outlined in the proposal. By accepting this proposal, the client agrees that the activities and outputs outlined in the proposal meets its requirements.

·  Variation of the programme of work outlined in this proposal will be by mutual consent. Should my understanding of your needs change as we proceed through the assessment and action-planning process, I will bring this to your attention and provide you with a revised work programme. 

·  In the event of termination, payment will be made for the work undertaken up to the termination.

·  Fees will be payable in two installments. An invoicing schedule will be mutually agreed at the outset of the commission.

·  I am committed to actively promoting equality and diversity and will work within the policies and procedures of the organisation.

·  I will not release any confidential information gained as part of this work except as agreed in advance or which is already in the public domain.

·  I may, as part of this work, undertake confidential interviews with staff, volunteers, stakeholders or beneficiaries of your organisation. I will undertake to keep this information confidential, and I will not share this information with you in a way that compromises any individual’s anonymity, unless given permission to do so by the interviewees/respondents affected.

·  Notwithstanding this commitment to confidentiality, respondents will be advised that if they reveal information that raises concerns for their safety or the safety of others, I will raise these concerns with the appropriate authorities.

·  Copyright of written reports produced as a result of the commission will rest with the client, who will acknowledge the work of the author in any documents produced.

·  I will retain copyright of all processes, workshop materials, guidance notes, questionnaire schedules, tools and templates that I produce in order to undertake the programme of work and produce the final written reports.

·  I will undertake the commission with reasonable care and skill. However, I will not be responsible for any losses, penalties, surcharges, interest or other liabilities arising from the supply by you or others of delayed, incorrect or incomplete information, or your or others’ failure to supply any appropriate information.

·  The client acknowledges that it is their responsibility to determine the risks associated with any particular course of action adopted as a result of the work undertaken by me, including obtaining any and all legal and professional advice necessary in order to carry out those actions. The client acknowledges that it is their responsibility to competently deliver any actions and will not hold me liable for any failure of future actions taken as a result of advice or guidance provided as part of this commission. The client will not hold me liable for any failure to procure finance from any source.
